Paint The Town expects and will accept only the utmost professionalism from its employees.  The following handbook outlines the company policy of Paint The Town.  Each employee must agree to this policy and is held to the high standards outlined in this Employee handbook.

Paint The Town has developed its own policies and procedures which guide and direct the company's daily operations and future growth.  The following is a copy of the Company Policy Handbook.

1.0 PURPOSE

The purpose of this document is to insure all company policies are defined, documented, and understood by all persons employed by Paint The Town.  These policies establish responsibilities of both the employer and the employee and are to be used as general guidelines for conducting daily operations.

2.0 Mission Statement

Our mission is to perform the highest quality work at competitive prices to meet the needs of all customers.  Our professional employees are honest and reliable and will exceed customer expectations.  Each and every job will be completed by our talented staff in a timely manner and with the utmost care.

3.0 SCOPE

Paint The Town has developed company policies for the purpose of defining general operating guidelines and conveying those guidelines to its employees.  All employees must be able to read and understand the intent of these guidelines and agree to abide by the requirements set forth by each policy.

 

These policies will be made available to every new hire for review immediately upon employment.  The employee will have one full pay period to review the document and respond to management with questions or concerns regarding any or all policy.  Once all policies have been reviewed, understood, and agreed to by the employee, a signed copy of this document will be produced and permanently issued to the employee for their future reference.  A copy of the signed coversheet, which serves as an acknowledgment form, will be filed with the employee records.  Policies are revision controlled and as policies are revised, new revisions are distributed to each employee.

 

Failure to comply with any of the company policies may result in disciplinary action, including termination.

4.0 DEFINITIONS

4.1 Employee -    Any person who is compensated by Paint The Town for services rendered is considered an employee and is required to adhere to the requirements set forth by company policy.  This includes all salaried, hourly, contracted, commission-only, full-time, and part-time personnel.

 

5.0 COMPANY POLICIES 

5.1 Hours of Work

 

The normal workday varies depending on the availability of hours and the number of hours each employee has requested. While employees are expected to work the number of hours that they have requested, Paint The Town does not guarantee that an employee will actually work that many hours in any given day or week.  Hourly employees are only paid for the hours worked.  Employees are not paid for drive time to and from work. The only paid drive time is from one job site to another if job assignment is changed by supervision in the middle of a shift.

 

Overtime work is only performed when necessary and approved in advance by your Supervisor. You are encouraged and expected to work necessary overtime when requested.

 

All employees are to record the actual time that work is started and the actual time that work is finished on his/her time sheet each day.  Lunch breaks and other unpaid breaks should be calculated into the total hours worked each day.

 

All employees should be allowed fifteen minutes at the end of each work day for clean up.  All brushes and other tools should be cleaned and stored in the appropriate places before the employee leaves the job site each day.

 

5.2 Breaks

 

Paint The Town provides (2) ten minute paid breaks per eight hour shift and one ten minute paid break per four hour shift.  There is one break in the morning and one break in the afternoon for eight hour shifts.  Breaks are optional.

 

Every eight hour shift allows for one thirty minute lunch.  Lunch breaks are not paid and are not mandatory.  Employees may take lunch off-site but must be prompt.  The same clock-in, clock-out rules apply as in the Hours of Work Policy, Section 5.1.

 

5.3 Attendance and Punctuality

 

Employees are expected to arrive at work before they are scheduled to start and be at their position productively engaged in company business by the scheduled start time. All time off must be requested in advance with the exception of sick leave.  Paint The Town views attendance as one of the most important facets of your job performance review. All unapproved absences will be noted in the employee's personnel file. Excessive absences, including sick leave, will result in disciplinary action, up to and including termination.  If you need time off, then receive approval in advance.

 

5.4 Dress Code

 

Employees of Paint The Town are expected to present a clean and professional appearance when at work. Employees who come in contact with customers or the public are expected to dress in accepted corporate tradition.  For field personnel this means a Paint The Town shirt and khaki or white pants or shorts.  When working on commercial jobs all safety requirements must be met such as hard hats, long pants, work boots, and safety glasses.

 

It is just as essential that all employees act in a professional manner and extend the highest courtesy to co-workers, customers, vendors, and other trades. A cheerful and positive attitude should be displayed at all times.

 

5.5 Time Off

 

It is acceptable for employees to take time off for personal reasons, but absenteeism should be kept to a minimum.  Time off is only allowed with prior approval.  All time off requests should be made to a supervisor as soon as possible.  If the requested time off is known in a week or more in advance, a written request should be submitted to the office for filing.

 

If an employee is unable to work due to illness, the employee must notify his immediate supervisor as soon as possible and always before the employee is scheduled to report to work.

 

5.6 Pay Periods

 

Paint The Town pays all hourly employees biweekly (every other week).  Pay periods run from Friday to the following Thursday of each week for two consecutive weeks.  Pay checks are distributed every other Friday.  Each employee is responsible for making arrangements to pick up his or her check.

 

5.7 Conduct

 

5.7.1   Language

 

All employees are to use appropriate language when in the field and at all times in general.  No profanity is allowed.  No racist, sexist, or discriminating remarks will be tolerated.

 

5.7.2   Radios

 

Radios are not permitted on the job.  If a customer turns his or her own radio on for the enjoyment of the crew, then it is acceptable.  Employees should never ask a customer to turn the radio on.

 

5.7.3   Gossip

Employees are not to gossip about anything relating to the company or employees of the company whether on the job or off.  Employees caught discussing pay rates are subject to an immediate pay reduction or employment termination.  If you have an issue with the company, then discuss the issue with the owners in a private meeting.

5.7.4   Cell Phones

 

Employees are allowed to use cell phones during breaks and lunches.  Cell phones should only be used while on the clock if the call is company related.  Certain exceptions will be made on an individual basis.

 

5.7.5   Smoking

 

Employees are permitted to smoke only in the confines of their vehicles.  Smoking is strictly prohibited inside any building or structure within the job site area.  Smoking should take place during designated break times.  Trash resulting from smoking is to be disposed of properly by the employee.

 

This smoking policy shall not be broken even in cases where the customer gives consent.

 

5.8 Food & Beverage

 

Food and beverages may be consumed at the job site.  Consumption of food should be limited to breaks when possible.  Drinks may be on hand with the employee as he or she is working.  Trash should be disposed of immediately after consumption.  Any employee leaving trash anywhere on a job site other than a designated trash bag or bin is subject to disciplinary action.  Employees are responsible for providing their own food and beverages.  Paint The Town may provide food and/or beverages on occasion at the discretion of the supervision.

 

5.9 Clean Up

 

Field employees are responsible for keeping the job site clean and organized.  Food and beverage trash should be disposed of immediately after consumption (Ref. Section 5.8 Food & Beverage). At the end of each work day, employees are allowed adequate time to clean up their tools and work area before leaving for the day (Ref. Section 5.1 Hours of Work).  Clean up of brushes, rollers, sprayers, etc., should be performed in designated areas only.  These areas should be considerate of the surrounding landscaping and work vicinity.

 

Materials should be stored in one designated area away from traffic and clear view.  It should be stored in an organized manner and should meet all OSHA and environmental standards.  If ladders have to be left on the job site, they should be left in a safe area away from clear view.

 

5.10 Restrooms

 

Field employees are discouraged from using a customer’s private restroom facility, especially when working at a personal residence.  Construction sites should provide portable restrooms.  If portable restrooms are not provided, employees are allowed to go off-site when public restrooms are near by.  Using private facilities is allowed only when the customer gives authorization, and even then, use should be limited.

 

5.11 Tools

 

Field personnel should always maintain a minimum amount of tools essential for performing basic painting tasks.  Employees should not share their tools.  Employees must keep their tools in their tool box when not in use, and all personal tools should be removed from the job site at the end of each work day.  The following is a list of tool requirements to be furnished and maintained by the employee:

 

1) Paint brushes (oil and latex) various sizes

2) Painter’s tool (5in1)

3) Caulk Gun

4) Wire Brush

5) Duster

6) Screw Drivers

7) Nail Set

8) Tool Box

 

Paint The Town may provide one or more of the listed tools to employees on an as needed basis.

 

5.12 Transportation & Parking

 

All employees of Paint The Town must be able to provide their own transportation to and from work. It is acceptable, and is encouraged, to car pool to job sites that have limited parking.  When driving personal vehicles to a job site, employees should always park on the street or designated parking areas.  Employees are not to park in a customer’s driveway or yard whenever possible.  Company vehicles are allowed on the project property but should use extreme caution and consideration when doing so.

 

 

5.13 Drugs and Alcohol

 

Paint The Town takes seriously the problem of drug and alcohol abuse, and is committed to provide a substance abuse free work place for its employees. This policy applies to all employees of Paint The Town, without exception, including part-time and temporary employees.

 

No employee is allowed to consume, possess, sell or purchase any alcoholic beverage while on the clock. No employee may use, possess, sell, transfer or purchase any drug or other controlled substance which may alter an individual’s mental or physical capacity.  Paint The Town will not tolerate employees who report for duty while impaired by use of alcoholic beverages or drugs.  Employees who violate the Drug and Alcohol Policy will be subject to disciplinary action, including termination.

 

5.14 Disciplinary Action

 

Any employee violating company policy is subject to disciplinary action.  The type of disciplinary action taken is dependent on the nature of the violation and varies from policy to policy.  However, in most cases, the following process applies when an employee violates policy:

 

1st Offense: Verbal Warning

2nd Offense: Written warning

3rd Offense: 1 Day suspension w/o pay

4th Offense: Possible termination or pay reduction

 

Depending on the severity of the violation and the policy violated, these steps can be overruled.  It is up to the supervisor and management to determine the appropriate course of action.

 

5.15 Termination

 

Ohio is a “Right-to-Work” state which means an employer can terminate an employee without cause as long as race discrimination is not at issue.  However, it is not the intent of Paint The Town to terminate an employee for no reason.  Termination will only occur when:

 

A) an employee violates policy.

B) an employee falsifies information on his employment application.

C) an employee does not possess the necessary skills to perform the requirements of his position to the production and quality standards set by the company.

D) there is not enough work available to keep the employee gainfully employed.

 

Upon termination, the employee’s final paycheck will be held until all company tools and equipment, which are in possession of the employee, are returned to the office. Any employee terminated for any reason other than work shortage may not return to any of Paint The Town’s job sites or properties without permission from the owners.

 

5.16 Finder’s Fee

 

Any non-employee who directly refers a job to Paint The Town is entitled to a finder’s fee.  The non-employee will receive 10% of the total profits made on the job (profit is the amount left over after all materials and labor are paid).  Paint The Town shall handle all bidding and other business related to the job referred by the non-employee.

 

5.17 Non-Compete

 

All employees of Paint The Town are considered sales people for the company and should always represent the company as such.  This means any potential new business opportunities that arise from current projects should be forwarded to the appropriate personnel.  When field personnel are approached with new sales opportunities, contact information should be turned in to the supervision or owners.  Such cases do not constitute a referral as mentioned in section 5.16.

 

Once the sales lead has been evaluated by management, a decision will be made on how to proceed with the client.  Any employee that does not report the new sales lead or attempts to keep the opportunity for himself is subject to disciplinary action including termination.

 

5.18 Evaluation Period

 

All employees will be considered as temporary employees for the first ninety days of employment.  This ninety day period allows sufficient time to evaluate the employee’s ability to meet the expectations set during the initial interviewing process. If an employee’s performance does not coincide with the capabilities portrayed during the interviewing process, then the employee may be terminated.

 

5.19 Holidays

 

Paint The Town observes major holidays but does not guarantee that all holidays will be time off.  Depending on the work load, employees may be asked to work holidays.  Paint The Town will first seek volunteers to work on holidays when possible.

 

5.20 Inclement Weather

 

During rain or inclement weather all employees are required to call the office or their direct supervisor to get information on work closings.  On days when snow and ice make travel conditions dangerous employees are expected to use common sense when deciding whether to travel to work.  If roads are covered with snow and ice it is general policy that all scheduled work will be delayed until the roads are at least partially cleared.

 

5.21 Sexual Harassment

 

Paint The Town will not condone or tolerate conduct which may constitute sexual harassment on the part of its management, supervisors, or field personnel. It is company policy that all employees have the right to work in an environment free from any type of illegal discrimination, including sexual harassment. Any employee found to have engaged in such conduct will be subject to immediate discipline up to and including termination.

 

5.22 Job Classification for Field Personnel

 

Painter’s Helper (Up to $7 per hour)

Commonly referred to as a “field trainee”, this individual has little experience working as a painter in a professional setting.  A Field Trainee should possess fundamental skills and some prior experience using basic painting tools such as brushes and rollers.  Primary job function is to assist more experienced painters by performing mundane tasks including set up, clean up, moving ladders, caulking, scraping, etc.

 

Apprentice ($8-$9 per hour)

Possesses the fundamental skills required to perform daily tasks associated with commercial and residential painting.  Has a good understanding of application processes and possesses a fair amount of product knowledge.  Has the ability to provide a quality product while meeting production standards.  This individual should be capable of using brushes, rollers, and other hand tools to complete most any task associated with commercial and residential painting projects.  An Apprentice should always work under direct supervision.

 

Journeyman ($10-$11 per hour)

This classification requires the individual to possess all the skills of an Apprentice.  In addition, this person should be able to use various types of spray equipment, including airless and conventional sprayers.  Proficient with various types of coatings, epoxies, stains, and varnishes. A Journeyman is very knowledgeable of most processes and products.  A self-starter, independent worker with excellent problem solving skills are all required qualities needed to attain a Journeyman classification. A Journeyman has the ability to assume a leadership role and may frequently be required to supervise a crew.  This person does not need direct supervision.

 

Master Journeyman ($12-$13 per hour)

This classification requires the individual to possess all the skills of a Journeyman.  This classification typically indicates a supervisory position such as a Crew Leader.  This person participates in planning jobs as well as coordinating the activities associated with the job.  This person should possess exceptional people skills, process and product knowledge, and excellent communication skills.  This individual is a motivator, quick thinker, and calm under pressure.

 

Master Painter ($14-$15 per hour)

This classification requires the individual to possess all the skills of a Master Journeyman.  This person usually participates in the estimating process of jobs and handles customer calls and concerns.  The Master Painter is required to handle all areas of company business from start to finish.
